Scope of application
Article 1

  1.  Contracts for accommodation and related agreements to be entered into between this Hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any particulars not provided herein shall be governed by laws and regulations and/or generally accepted practices.
  2.  In the case when the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices the special contract shall take precedence over the provisions of these Terms and Conditions, notwithstanding the preceding Paragraph.

Application for Accommodation Contract
Article 2

  1.  A Guest who intends to make an application for an Accommodation Contract with the Hotel shall notify the Hotel of the following particulars:
    1. Name of the Guest(s)
    2. Date of accommodation and estimated time of arrival
    3. Accommodation charges (based in principle on the Basic Accommodation Charges listed in the Attached Table No. 1)
    4. Other particulars deemed necessary by the Hotel.
  2. If Guests request to extend their stay, during their stay, beyond the date in subparagraph (2) of the preceding Paragraph, it shall be regarded as an application for a new Accommodation Contract at the time such request is made.

Conclusion of Accommodation Contracts, etc.
Article 3

  1. A Contract for Accommodation shall be deemed to have been concluded when the Hotel has duly accepted the application as stipulated in the preceding Article. However, the same shall not apply where it has been proved that the Hotel has not accepted the application.
  2.  When a Contract for Accommodation has been concluded in accordance with the provisions of the preceding Paragraph, the Guest is requested to pay an accommodation deposit set by the Hotel within the limits of Basic Accommodation Charges covering the Guest's entire period of stay (3 days when the period of stay exceeds 3 days) by the date specified by the Hotel.
  3. The deposit shall be first used for the Total Accommodation Charge to be paid by the Guest, secondly for cancellation charges under Article 6 and thirdly for reparations under Article 17 as applicable. The remainder, if any, shall be refunded at the time of payment for accommodation as stated in Article 12.
  4. If the Guest fails to pay the deposit by the date as stipulated in Paragraph 2, the Hotel shall treat the Accommodation Contract as invalid. However, the same shall apply only in the case where the Guest is thus informed by the Hotel when the period of Payment of the deposit is specified.

Special Contracts Requiring No Payment of Accommodation Deposit (Special Contracts Requiring No Accommodation Deposit)
Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no accommodation deposit after the Contract has been concluded as stipulated in the same Paragraph.
  2. In the case when the Hotel has not requested payment of the deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the date of payment of the deposit at the time the application for an Accommodation Contract has been accepted, it shall be treated as though the Hotel has accepted a special contract prescribed in the preceding Paragraph.

Refusal of Accommodation Contracts
Article 5

  1. The Hotel may not accept the conclusion of an Accommodation Contract under any of the following circumstances:
    1. When the application for accommodation does not conform with the provisions of these Terms and Conditions
    2. When the Hotel is fully booked and there is no vacancy
    3. When the Guest seeking accommodation is deemed liable to conduct himself/herself in a manner that will violate laws or act against the public order or good morals in regard to his/her accommodation
    4. When the Guest seeking accommodation is an organized crime group, a member of an organized crime group, a related company or association of an organized crime group, and/or a member of any antisocial forces
    5. When the Guest seeking accommodation is a company or other organization supporting the business activities of an organized crime group or a member of an organized crime group or equivalent
    6. When the Guest seeking accommodation is a company whose board members include a member of an organized crime group or equivalent
    7. When the Hotel and/or Hotel staff suffers from violent threat or unreasonable burden from the Guest seeking accommodation
    8. When the Guest seeking accommodation can be clearly identified as carrying an infectious disease
    9. When the Hotel is unable to provide accommodation due to natural calamities, malfunction of facilities and/or other unavoidable causes
    10. When the Guest seeking accommodation is obviously intoxicated and could cause annoyance to other guests or when the person is behaving in such a manner as to be an annoyance to other guests

Right to Cancel Accommodation Contracts by the Guest
Article 6

  1. The Guest is entitled to cancel the Accommodation Contract by notifying the Hotel.
  2.  If the Guest has cancelled the Accommodation Contract in whole or in part due to causes for which the Guest is liable (except in the case when the Hotel has requested payment of the deposit during the specified period as prescribed in Paragraph 2 of Article 3 and the Guest has cancelled before payment), the Guest shall pay cancellation charges as listed in the Attached Table No. 2. However, in the case when a special contract as prescribed in Paragraph 1 of Article 4 has been concluded, the same shall apply only when the Guest is informed of the obligation of payment of cancellation charges in case of cancellation by the Guest.
  3. If the Guest does not appear by 8:00 p.m. of the accommodation date without advance notice (2 hours after the expected time of arrival if the Hotel is notified), the Hotel may regard the Accommodation Contract as being cancelled by the Guest.

Right to Cancel Accommodation Contract by the Hotel
Article 7

  1. The Hotel may cancel the Accommodation Contract under any of the following circumstances:
    1. When the Guest is deemed liable for conduct and/or has conducted himself/herself in a manner that will violate laws or act against the public order and good morals in regard to his/her accommodation
    2. When the Guest can be clearly identified as carrying an infectious disease
    3. When the Hotel is unable to provide accommodation due to natural calamities and/or other causes of force majeure
    4.  When the Guest is an organized crime group, a member of an organized crime group, a related company or association of an organized crime group, and/or a member of any antisocial forces
    5. When the Guest is a company or other organization supporting the business activities of an organized crime group or a member of an organized crime group
    6. When the Guest is a company whose board members include a member of an organized crime group or equivalent
    7. When the Hotel and/or Hotel staff suffers from violent threat or unreasonable burden from the Guest
    8. When the Guest violates Article 19 of the Ordinance Governing the Maintenance of Appropriate Operation of Kyoto City Hotels (Reasons for Rejecting Accommodation)
    9. When the Guest is obviously intoxicated and could cause annoyance to other guests or when the Guest is behaving in such a manner as to be an annoyance to other guests
    10. When the Guest does not observe prohibited actions such as smoking, tampers with fire-fighting facilities and otherwise breaches Hotel Regulations stipulated by the Hotel (restricted to particulars deemed necessary in order to avoid causing fires)
  2. If the Hotel has canceled the Accommodation Contract in accordance with the preceding Paragraph, the Hotel shall not charge the Guest for any of the services during the contractual period he/she has not received.

Accommodation registration
Article 8

  1. Guests are required to register the following items at the front desk of the hotel on the day of stay.
    1. Guest's name, age, gender, address and occupation
    2. For foreigners, nationality, passport number, place of entry and date of entry
    3. Departure date and scheduled departure time
    4. Other particulars deemed necessary by the Hotel.
  2. If the guest intends to pay the charges under Article 12 by a method that can be used in place of currency such as travel checks, accommodation vouchers, credit cards, etc., they must be presented in advance at the time of registration set forth in the preceding paragraph.

Room usage time
Article 9

  1. Guests can use our guest rooms from 15:00 to 12:00 the next day. However, if you stay consecutively, you can use it all day except the arrival date and departure date.
  2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept the use of rooms outside the hours specified in the same paragraph. In this case, the following additional charges will be charged.
    1. 30% of room rate for less than 3 hours
    2. 50% of room rate for over 3 hours and less than 5 hours
    3. 100% of room rate for over 5 hours
  3. If the guest intends to pay the charges under Article 12 by a method that can be used in place of currency such as travel checks, accommodation vouchers, credit cards, etc., they must be presented in advance at the time of registration set forth in the preceding paragraph.

Compliance with usage rules
Article 10

  1. Guests are required to comply with the usage rules established by the hotel and posted in the hotel.

  1. Detailed business hours of the hotel's facilities will be announced on the in-room TV screen.
  2. The time in the preceding paragraph may be changed temporarily if necessary. In that case, we will inform you by an appropriate method.

Payment of charges
Article 12

  1. The breakdown of accommodation charges, etc. payable by the guest and the calculation method thereof are as listed in Attached Table 1.
  2. Payment of the accommodation charges, etc. in the preceding paragraph shall be made at the front cashier at the time of departure of the guest or when requested by the hotel by currency or a travel check, accommodation voucher, credit card, etc. approved by the hotel. I will do it.
  3. Even if the guest does not voluntarily stay after the hotel has provided the guest room and made it available, the accommodation fee will be charged.

Our responsibility
Article 13

  1. The Hotel will indemnify the guest for any damages caused to the guest in the performance of the accommodation contract and related contracts, or due to the non-performance thereof. However, this does not apply if it is not due to reasons attributable to the hotel.
  2. The hotel has corporate liability insurance in case of a fire.

Handling when the contracted guest room cannot be provided
Article 14

  1. If the hotel is unable to provide the guest with the contracted room, the hotel shall, with the consent of the guest, arrange other accommodations under the same conditions as much as possible.
  2. If the hotel cannot arrange other accommodation facilities regardless of the provisions of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty, and the compensation fee will be applied to the damage compensation amount. However, we will not pay the compensation fee if there is no reason to blame the hotel for not being able to provide the guest room.

Handling of deposits, etc.
Article 15

  1. In the event of loss, damage, or other damage to the goods, cash, or valuables deposited by the guest at the front desk, the hotel will compensate for the damage unless it is force majeure.
  2. If the guest brings in goods, cash, or valuables that were not left at the front desk and is lost or damaged due to the intention or negligence of the hotel. , The hotel will compensate for the damage. However, if the guest does not declare the type and price in advance, the hotel will compensate for the damage up to 150,000 yen.

Storage of guest's baggage or personal belongings
Article 16

  1. If the guest's baggage arrives at the hotel prior to the stay, it will be responsibly stored only if the hotel agrees before the arrival and will be handed to the guest at the front desk when checking in.
  2. If the guest's cash or valuables (*) are left behind at the hotel after the guest has checked out, the hotel shall contact the owner and request instructions. However, if there is no instruction from the owner or if the owner is unknown, in principle, it will be stored for 7 days including the date of discovery, and then delivered to the nearest police station. Other items will be disposed of after 2 months. However, food, drinks, cigarettes, magazines, etc. will be disposed of the day after check-out.
    * 1 "Present / valuables" are wallets (current), credit cards, cameras, mobile phones, watches, personal belongings, prepaid cards, and other items of fixed value, driver's licenses, insurance cards, etc. Goods that may be misused by a third party.
  3. The responsibility of the Hotel for the storage of guest's baggage or personal belongings in the case of the preceding two paragraphs shall be in the provisions of paragraph 1 of the preceding article in the case of paragraph 1 and in the case of the preceding paragraph. It shall be in accordance with the provisions of paragraph 2.

Guest responsibility
Article 17

  1. If the Hotel suffers damage due to the intention or negligence of the Guest, the Guest shall compensate the Hotel for the damage.

Disclaimer
Article 18

  1. The use of computer communication from within the hotel is at the guest's own risk. The Company shall not be liable for any damage caused to the user as a result of the service being interrupted due to a system failure or other reasons while using computer communication. In addition, if the Company or a third party suffers damage due to an act that the Company deems inappropriate for using computer communication, the damage will be compensated.

privacy protection
Article 19

  1. Personal information disclosed by guests in connection with the accommodation contract will be managed in accordance with the "Act on the Protection of Personal Information".

Preferred language
Article 20

  1. This agreement is written in Japanese and English, but if there is any discrepancy or difference between the two, the Japanese version shall prevail.

  1. The accommodation fee will be the fee posted at the time of booking.
  2. There is no additional charge for children under the age of 6 staying in the same room as their parents or guardians. However, only if there is enough space for the customer.
  3. If the tax law is amended, it shall be in accordance with the amended provisions.
